Wow... What does charging
Wow... What does charging less and offering refunds have to do with race? There should have been no other requirements from the state except abide by the laws of this state, pay the penalty or we will shut you down. We all need to know what else is not in this story. What were the original complaints to the AG? What percent of the dealer's BHPH business comes from minorities? Are his rate of repossessions greater for minorities? Were there additional complaints outside of the discrimination allegations? I hope you have another article that interviews and investigates the dealer about this case. Because this settlement is clearly less than the cost of defending the dealer and repairing the continued PR damage the length of this case would cause, it would be nice to know why there was a clear government over reach that specifically tells the dealer how to run his business inefficiently and with less profit in this settlement.

Great article - This practice goes on so much that its dishearting to see that people are taking advantage of in this manner. Kia Dealership in Metairie, La. seems to be practicing in the same manner. Staying right under the radar. Taking advantage of people with little knowledge of the system.

There must be more to this story
The dealer is being severely punished by this consent order. To enter into such a one-sided consent decree the dealer must have had no leverage at all. This leads me to believe that the dealer had nothing to show the regulators when they came calling. You can say that you do things the right way and that may be true, but in this age, if you can't show documentation to support your position, you are doomed.

Most dealers actively work towards working within the boundaries of the law. I find it amazing that as part of the settlement, this dealer is not allowed to charge what the state legally allows, and more importantly, that Tompkins makes a statement about illegal discrimination, but nothing in this article (case) shows this dealer was discriminating. Scary...
